Assault

Each assault case is different, but there are a few things you must be aware of.

#1 There are a lot of different types of assault charges.

In Texas, the legislature has broke up assaults int varying degrees and types, each with their own range of punishment and trial issues. When we meet, we'll go over the exact type of charge you are facing, and what the ramifications are.

#2 Assaults with Family Violence

When there has been an accusation of an assault with Family Violence a Judge will generally order a "Magistrates Order for Emergency Protection." This order from the judge acts like a "restraining order," however to be clear - it is different. This order will often times prevent the accused from communicating to the alleged victim in any harassing way, or visiting their home or place of employment. This can become very problematic when there are children involved, or when the accused simply has no where to go. The order will be in place for 61 days from the date of issuance.

#3 Sexual Assaults

Sexual Assaults are extremely complex cases. They usually involve Medical, Scientific, DNA, Circumstantial, and Witness evidence. Someone accused of sexual will be facing sex offender registration, as well has felony penalties. The legislature has provided for a range of sexual assaults that deal with children, the elderly, the disabled, and various other categories. #4 "Aggravated" Assaults

When the word "Aggravated" has been added to the charge it severely changes the options available to an accused. An "Aggravated" charge will usually include a deadly weapon of some sort, will eliminate some options for punishment, and will change parole considerations.
