Expunction of Criminal Records: Part 3 - Felony Expunction

Question:
I was charged with a felony, am I eligible for an Expunction?
Answer:
Yes, if you qualify. You're entitled to a felony expunction of your criminal records if:
1) you were never indicted, or
2) you were indicted, and the indictment was dismissed,and the statute of limitations has expired, or the indictment was dismissed because you completed an approved pretrial intervention program, or
3) you were indicted but the indictment was based on mistake/false information or similar reason indicated absence of probable cause; or
4) you have been released of any charge, and the charge did not result in a final conviction, and there was no court ordered community supervision (probation); AND
5) You have not been convicted of a felony in the 5 years preceding the date of the arrest.
One of the most important things to remember is that, generally, you have to WAIT 5 YEARS from the date of your charge.
I know, its a long time, but its well worth the wait.
