If you are charged with a 3g offense a JUDGE can not place you on Community Supervision (probation).
3g offenses are:
A) Murder
B) Capital Murder
C) Indecency with a Child
D) Aggravated Kidnapping
E) Aggravated Sexual Assault
F) Aggravated Robbery
G) Certain Offenses Under the Health and Safety Code
H) Sexual Assault
I) Injury to a child, elderly, or disabled, if the offense is punishable as a felony of the first degree and the victim of the offense is a child
J) Sexual Performance by a Child
K) Criminal Solicitation (if punishable as a first degree)
L) Compelling Prostitution
M) Trafficking of Persons
OR
* if a deadly weapon was used or exhibited during the commission of a felony offense or immediate flight therefrom, and the defendant used or exhibited the deadly weapon or was a party to the offense and knew that a deadly weapon would be used or exhibited.
If you are charged with a 3g offense a JURY can not place you on Community Supervision (probation) if:
* You are charged with Indecency with a child, Aggrevated Sexual Assault, Sexual Assault, if the vicitm of the offense was younger than 14 years of age at the time the offense was committed.
* You are charged with aggravated kidnapping, if the vicitm of the offense was younger than 14 years of age at the itme the offense was committed and the actor committed the offense with the intent ot violate or abuse the victim sexually.
* You are charged with Sexual Performance by a Child
* You are charged with Murder
PAROLE
If you are convicted of a 3 g offenseyou're going to have to serve at least 1/2 of your sentence or 30 years, whichever is less, but not eligible for release in less than 2 calendar years.
