Automatic Driver's License Suspension on Conviction of Intoxication Offenses

This deals with suspensions as a result of a CONVICTION. Keep in mind that DPS "administrative" suspensions are different than suspensions upon conviction by a county or district court.
If you are convicted of:
1) Driving While Intoxicated:
a. 90 days to 1 year if first offense
b. 180 days to 2 years if subsequent offense
c. 1 to 2 years if second offense is within 5 years
* There is no suspension if you are placed on probation, and as a condition of your probation, you are ordered to take, and successfully completes, an educational program within 180 days of the conviction, or you are required to equip your vehicle with a deep lung breath device. Also, there is no suspension if the jury recommends that the license not be suspended.
2) Driving while intoxicated with child passenger
a. 90 days to 1 year
3) Intoxication Assault (by motor vehicle)
a. 90 days to 1 year if first offense
b. 180 days to 2 year if subsequent offense
c. 1 year if second offense within 5 years
4) Intoxication Manslaughter
a. 180 days to 2 years if first offense
b. 1 to 2 years if second or subsequent offense within 10 years of offense
