MURDER (§19.02)
19.02(b)(1) - Intentional or Knowing
* A person
* Intentionally or knowingly
* Causes the death of an individual
PUNISHMENT:
*1st degree felony
*2nd degree felony, if proved at punishment by a preponderance of the evidence that death was caused under the immediate influence of sudden passion arising from adequate cause.
19.02(b)(2) - While intending serious bodily injury
*A person
*Intending to cause serious bodily injury
*Commits an act clearly dangerious to human life
*That causes the death of an individual
PUNISHMENT
*1st degree felony
*2nd degree felony, if proved at punishment by a preponderance of the evidence that death was caused under immediate influence of sudden passion arising from an adequate cause
19.02(b)(3) - While committing felony
*A person
*Commits or attempts to commit a felony (other than manslaughter(, and
* Either:
(a) in the course of an in furtherance of the commission or attempt, or
(b) in immediate flight from the commission or attempt
*Commits or attempts to commit an act clearly dangerous to human life
*That causes the death of an individual
PUNISHMENT
* 1st degree felony
*2nd degree felony, if proved at punishment by a preponderance of the evidence that death was caused under the immediate influence of sudden passion arising from an adequate cause
