The state has put this under penalty group 2, which makes it a serious felony.
For store owners, or those who have a lot of weight, you may be charged with delivery or "selling":
400 grams or more - 10 to 99 years and up to 100,000 fine
4 - 400 grams - 1st degree - 5-99 years and up to a 10,000 fine
1 to less than 4 grams - 2nd degree - 2-20 years and up to a 10,000 fine
less than 1 gram - state jail felony - 180 days to 2 years in jail and up to 10,000 fine
For mere possession:
400 grams or more - 5-99 years, and up to a 500,000 fine
4-400 grams 2nd degree felony
1 to 4 grams - 3rd degree felony
less than 28 grams - Class A misd
